What is the timeline of TM registration?
TM registration in Canada involves 6 steps:
Step 1: Review name reports, select code and submit.
Step 2: Initial examination and formalize by CIPO.
Step : CIPO approves or rejects as initial decision.
Step 4: Publish on Journal, wait 18 months for any objection.
Step 5: If no objections, final approval.
Step 6: To be registered with government.

Trademark Search Report: Short or Detailed

It's all about how much likelihood of rejection you want to take. A detailed report gives more likelihood of approval, while short report gives more likelihood of rejection.
Accepted file types: jpg, gif, png, pdf, doc, docx, Max. file size: 32 MB.

Which report should I choose?
Most people choose detailed report to save time and money. A search report tells the likelihood of getting the trademark approved or declined. The detailed report lists down exact & similar names in all provinces in Canada. A short report does not do such. A decline has also risk of loosing the whole money since govt. does not give refund.

Word Only or Design Mark (Logo)

As per CIPO rules and regulations, application for word mark or design mark (logo) must be submitted separately. If you want to trademark a word and a logo both, you need to submit two separate applications.
Our company has in house professional graphics & logo designer. If you choose our service, the designer will contact you and consult you, in case you have any concept or preference in mind. The designer then will design 3 logos based on the concept, you will select one with an unlimited revision options. You will also receive the vector file in case you want to keep it for future edit.
As per CIPO regulations, the design or logo must satisfy certain requirements such as:
1. Must be in .tif, .jpg, .gif without motion, .png, .bmp.
2. File size must not exceed 10.49MB.
3. Maximum image size: 8cm x 8cm.
4. Maximum resolution: 300dpi.

What is word mark and design mark?
A word mark is registered in a standard keyboard character, that gives the protection of a name or a slogan or a phrase written in any style or font. On the other hand, a design mark is registered as an image (normally logo) which may consists of slogans, words, foreign words, symbols, shapes in various style, size, font and color etc.
Which one should I choose?
Generally a word mark gives wider level of protection, while a design mark gives more distinctive level of protection. It depends on products and services that are relevant with this trademark. For developing a brand, we suggest to do both, word mark and design mark. However, if you want to do only one mark, generally, we suggest to do a word mark first. When a word mark is approved, adding a design mark (logo) can make it more distinctive and protects you from possible objections.

8. Products and Services

We strive to provide accurate information regarding our products and services. However, we do not guarantee that all information is complete, accurate, or error-free.

Availability of services and products may change without notice.

Prices may be modified at any time.

8.1 Address Service

The Address Service provides a business registration address where permitted by law.

Use of the Address Service requires execution of a separate Address Service Agreement.

Mail Scanning Service limitations:

  • Only official government correspondence will be accepted.
  • Government mail will be scanned and forwarded digitally.
  • Personal mail, packages, bank statements, and marketing materials will be refused.

The service operates on an annual subscription basis and requires timely renewal.

Failure to renew may result in:

  • Collection proceedings.
  • Notification to government authorities.
  • Loss of authorization to use the address.
  • Potential legal consequences.

8.2 Agent Service

The Agent Service satisfies statutory requirements where a local representative is required.

A separate Agent Service Agreement must be signed before service begins.

The designated agent may:

  • Receive official government correspondence.
  • Act solely for statutory registration purposes.

The designated agent may not:

  • Operate the business.
  • Enter contracts.
  • Make business decisions.
  • Act beyond statutory requirements.

8.3 Government Information and Documentation Fees

Certain government-issued information may be available at no government cost; however, Ontario Corporate Filing Center may charge service fees for retrieving, processing, securing, and delivering such information.

Examples include:

  • Business Numbers.
  • Ontario Company Keys.
  • Other government-issued identifiers or credentials.

9. Purchases and Payment

All prices are listed in Canadian Dollars (CAD).

Accepted payment methods include:

  • Visa.
  • Mastercard.
  • American Express.
  • Discover.
  • PayPal.
  • Interac.

Customers must provide accurate billing and payment information.

A binding contract is formed once payment has been successfully processed.

We reserve the right to reject any order where fraud, discrepancies, or verification concerns are identified.

10. Service Term and Termination

These Terms remain effective while you use our services.

We reserve the right to suspend or terminate services without notice where permitted by law.

Termination may occur if:

These fees remain non-refundable regardless of cancellation timing.

12.2 Refundable Fees Under Certain Conditions

Refunds may be available if work has not yet commenced on specific services.

  • Government filing fees.
  • Draft preparation fees.
  • Company Key retrieval fees.
  • Shipping fees.
  • Future-dated filing fees.

12.3 Add-On Services

Certain add-on services may qualify for refunds if work has not started.

  • Minute Books.
  • Initial Returns.
  • Annual Returns.
  • Company Keys.
  • Domains and Email Services.
  • Google Listings.
  • Business Numbers.
  • CRA Account Registrations.
  • Share Certificates.
  • Corporate Seals.
  • Trademark Services.

12.4 Company-Initiated Refunds

Refunds may be issued where Ontario Corporate Filing Center is unable to complete services due to factors within its control.

12.5 Chargebacks and Disputes

Ontario Corporate Filing Center reserves the right to dispute chargebacks and provide supporting documentation when responding to payment disputes.

13. Third-Party Websites and Content

Our website may contain links to third-party websites and content.

We do not control, endorse, or assume responsibility for third-party websites, products, services, or content.

Use of third-party websites is at your own risk.

14. Privacy Policy
